These Terms of Service ("Terms") govern your use of The Homework App mobile application (the "App") provided by The Homework App ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
The App is intended for use by students and individuals managing academic assignments. If you are under the age of 18, you represent that you have obtained the consent of a parent or legal guardian to use the App and that your parent or guardian has reviewed and agrees to these Terms on your behalf.
To use certain features of the App, you must create an account using Sign in with Apple. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under your account. You agree to provide accurate information and to notify us promptly of any unauthorized use of your account.
You may use the App solely for your personal, non-commercial use to manage homework assignments, track academic progress, and utilize the study tools provided. You agree not to:
The App allows you to connect to third-party school learning management systems, including but not limited to Canvas, Schoology, StudentVue, PowerSchool, and Aeries. By connecting a school platform, you represent and warrant that:
We are not responsible for the availability, accuracy, or security of any third-party school platform. Your use of these platforms through the App is at your own risk.
The App offers both free and subscription-based ("Pro") access. Certain features are available only to Pro subscribers.
Pro subscriptions are billed through Apple's App Store. By purchasing a subscription, you agree to Apple's terms of sale. Subscription fees are charged to your Apple ID account at confirmation of purchase.
Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. You may manage or cancel your subscription through your Apple ID account settings or through the App's Settings. No refunds will be provided for partial billing periods, except as required by applicable law or Apple's refund policies.
We reserve the right to change subscription pricing. Any price change will take effect at the start of your next billing period following notice of the change.
The App, including its design, code, graphics, user interface, and content (excluding user-generated content), is owned by us and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App in accordance with these Terms. This license does not grant you any right to modify, distribute, or create derivative works based on the App.
You retain ownership of all data you create or import into the App, including assignments, notes, and class information ("User Content"). By using the App, you grant us a limited license to store, process, and display your User Content solely for the purpose of providing the App's functionality to you. We do not claim ownership of your User Content and will not use it for any purpose other than operating the App on your behalf.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
The App is a productivity tool and is not a substitute for direct communication with your school, teachers, or academic advisors. You are solely responsible for verifying the accuracy of any academic information displayed in the App.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF ACADEMIC CREDIT, MISSED DEADLINES, INACCURATE GRADE CALCULATIONS, OR LOSS OF ACCESS TO SCHOOL PLATFORM DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US FOR USE OF THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50.00), WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless The Homework App and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:
We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease. You may terminate your account at any time by using the Delete Account feature within the App. Sections 8, 9, 10, and 12 shall survive any termination of these Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the App shall be resolved exclusively in the state or federal courts located in Clark County, Nevada, and you consent to the personal jurisdiction of such courts.
If any provision of these Terms is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the App and supersede all prior agreements, representations, and understandings.
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the App or by other appropriate means. Your continued use of the App after any modification constitutes your acceptance of the revised Terms.
